Terms of Service – January 10, 2026

These Terms of Service (“Terms”) govern all services provided by Tulla, Tulla Media Corporation, and related entities (“we,” “us,” or “our”) to clients (“you” or “client”).

By accessing our website, using our services, requesting work, making payments, or continuing an existing business relationship with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Scope of Services

Services may include, but are not limited to, web hosting, website development, content management systems (CMS), databases, email services, server administration, consulting, and related digital services, strictly as negotiated with each client.

Any services, resources, storage, bandwidth, or support outside the agreed scope will be considered additional and may be subject to separate fees.

Hosting Resources and Usage Limits

Hosting services include server space, websites, CMS platforms, databases, email services, and bandwidth only as expressly agreed. Excessive usage or additional resource requirements may result in additional charges or service adjustments.

Backups and Data Responsibility

Automated backups are typically performed on a periodic basis (generally monthly), and manual backups may be performed at our discretion, usually quarterly. These backups are included as part of the service as negotiated.

While we take reasonable and industry-standard measures to safeguard data, backups are provided on a best-effort basis and are not guaranteed. External factors beyond our control may affect data integrity.

Clients are encouraged to maintain independent backups. We are not an insurer of data.

Email Services and Third-Party Providers

If a client requests the use of third-party email providers (e.g., Microsoft 365, Google Workspace), any configuration, migration, or coordination required will be custom-quoted and billed separately.

Similarly, if a website is hosted externally but email services are requested from us, migration or setup work will be quoted separately. Monthly service fees remain unchanged unless otherwise agreed.

Software Versions, Updates, and Legacy Systems

Our infrastructure primarily operates on UNIX/Linux-based systems using technologies such as PHP, MySQL, and WordPress.

New accounts include up to two (2) years of compatibility-related upgrades to commonly used software components when required to maintain operational compatibility.

After this period, or for websites migrated from third-party servers, any updates, upgrades, or code modifications required will be quoted and billed separately.

Clients who choose not to update outdated software may have their systems maintained as legacy configurations only for as long as server environments permit. We are not responsible for failures, incompatibilities, or security issues arising from outdated or unsupported software.

Code Impact and Estimates

Software updates may require code modifications that could affect website functionality. Where applicable, we will provide a good-faith estimate of hours required. Estimates are not guarantees and may reasonably vary based on complexity.

Additional Services

Any services not expressly included—such as analytics reports, audits, performance optimization, consulting, or special requests—will be custom-quoted and performed only upon client approval.

Migrations and Offboarding

Migration of websites, databases, email data, and related assets away from our systems starts at $1,500 USD, depending on complexity. Deliverables are provided as-is.

We do not provide instructions, training, or coordination with third-party providers unless expressly requested and paid for in advance.

Payments, Fees, and Outstanding Balances

All fees must be paid according to agreed terms. Services may be suspended or terminated for non-payment. All outstanding balances must be settled before cancellation or migration is completed.

Term, Cancellation, and Notice

All cancellations must be submitted in writing via certified mail to:

Notice must be received at least three (3) months prior to the desired cancellation date.

Cancellation becomes effective only after:

  • The original agreement term has been fulfilled or
  • Six (6) months of payments have been made, whichever is greater
  • All outstanding balances are paid in full

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or business interruption.

Modifications to These Terms

We reserve the right to modify these Terms of Service at any time. Updated versions will be posted on our website and will govern all ongoing and future services.
